Terms of Service

These Terms are an agreement between you and Talkstack (“Talkstack”, “we”, “us”) about your use of the Talkstack website and service (the “Service”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Please read Section 15: it requires most disputes to be resolved by individual arbitration and waives class actions.
1. The Service is a beta
Talkstack is an early, experimental product offered free of charge for testing. Features may change, break, or be removed at any time; the Service may be unavailable, and data may be lost. We may end the beta or the Service at any time. Keep your own copy of anything you care about.
2. Who can use it
You must be at least 16 years old. If you are under 18 (or the age of majority where you live), you confirm that a parent or guardian has agreed to these Terms on your behalf. You may not use the Service if the law forbids it or if we have previously removed you.
3. Your account
Give accurate information, keep your sign-in credentials secure, and do not share your account. You are responsible for activity on your account. Tell us at jitenbhalavat.ai@gmail.com if you believe it has been compromised.
4. AI interviewer — not professional advice
The interviewer is an artificial intelligence, not a person. Its questions, replies, scores and feedback are generated automatically and may be inaccurate, incomplete, biased or inappropriate. They are for practice only and are not career, legal, or hiring advice. We do not guarantee any interview result, job offer, or outcome, and scores do not predict how any real employer will assess you. You are responsible for how you use the output.
5. Recording and transcripts
During an interview your microphone audio is streamed to our speech recognition provider, AssemblyAI, and converted to text. We do not store the audio; the transcript is stored, so that your interview can be graded and shown in your history. AssemblyAI may retain the audio and use it to improve its models under its own terms, as described in our Privacy Policy. You must accept our recording notice before starting an interview. Do not use the Service to capture anyone else’s voice without their consent.
6. Your content
You keep ownership of what you upload or say (“Your Content”): resumes, job descriptions, transcripts, profile details, and so on. You grant us a worldwide, non-exclusive, royalty-free licence to host, copy, process, transmit and display Your Content only as needed to operate and improve the Service for you and, for community content you publish, to show it to other users. This licence ends when you delete the content or your account, except for copies kept briefly in backups as described in the Privacy Policy. You confirm you have the rights to Your Content and that it does not include other people’s personal information without their permission.
7. Acceptable use
You agree not to:
- break any law, or use the Service to harass, threaten, defraud, discriminate against, or impersonate anyone;
- upload content that is unlawful, infringing, sexually explicit, hateful, or that contains malware;
- upload another person’s resume or personal data without their permission;
- attempt to get around plan limits, quotas, or security, or to access accounts or data that are not yours;
- scrape, reverse engineer, overload, or interfere with the Service, or use it to build a competing product;
- use the Service to generate content that violates the usage policies of our AI providers;
- resell or sublicense access to the Service.
8. Community profiles and bookings
Community features let users publish a profile and let other users book sessions with them. A profile you list is public: anyone with its link can view it without an account and search engines may list it, so publish only what you are comfortable sharing openly. Talkstack only provides the listing and booking tools. Mentors are independent users — not our employees, agents or contractors — and we do not verify their identity, credentials, employment history or advice. Sessions take place outside the Service (for example, on a video link the mentor provides), and any arrangement is solely between the users involved. All sessions are currently free; we process no payments. Use your judgment, do not share sensitive information you would not want shared, and report any profile or conduct that breaks these Terms to jitenbhalavat.ai@gmail.com. We may remove or hide any profile, service or booking at our discretion.
9. Plans and coupons
The Service is free during the beta, within the limits shown on the pricing page and in your settings. A coupon may unlock higher limits for the period it states; coupons have no cash value, cannot be transferred, and may be withdrawn if misused. We process no payments today. If we introduce paid plans, we will show the price and terms before charging you and you will need to agree to them.
10. Our property
The Service, including its software, design and branding, belongs to Talkstack and its licensors. These Terms give you a personal, revocable, non-transferable right to use it as offered and nothing more. If you send us feedback or suggestions, we may use them freely without any obligation to you.
11. Copyright complaints
If you believe content on the Service infringes your copyright, email jitenbhalavat.ai@gmail.com with the work, where it appears on the Service, your contact details, and a statement that you have a good faith belief the use is unauthorised. We will remove infringing content and may close the accounts of repeat infringers.
12. Ending your use
You can stop using the Service and delete your account at any time from Settings. We may suspend or terminate your access at any time, with or without notice, if you break these Terms, if required by law, or if we end the Service. Sections 4, 6 (for content still held), 10, and 13–17 survive termination.
13. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER OR MENTOR, OR FOR ANY SESSION BETWEEN USERS. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TALKSTACK AND THE PEOPLE WHO OPERATE IT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OPPORTUNITIES, OR EMPLOYMENT, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THEIR POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US$50. Nothing in these Terms limits liability that cannot be limited by law.
You agree to indemnify and hold harmless Talkstack and the people who operate it from claims, losses and costs (including reasonable attorneys’ fees) arising from Your Content, your conduct toward other users, or your breach of these Terms or of the law.
15. Disputes — arbitration and class-action waiver
Talk to us first. Before filing a claim, email jitenbhalavat.ai@gmail.com describing it, and give us 30 days to try to resolve it informally.
Arbitration. If we cannot resolve it, you and Talkstack agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court, or seek an injunction for misuse of intellectual property. The Federal Arbitration Act governs this section.
No class actions. Disputes will be resolved only on an individual basis, not as a plaintiff or class member in any class, consolidated or representative proceeding. If this waiver is found unenforceable for a claim, that claim must be decided in court, not in arbitration.
Opting out. You may opt out of this Section 15 by emailing jitenbhalavat.ai@gmail.com within 30 days of first accepting these Terms, with your name, account email and a clear statement that you opt out of arbitration.
16. Governing law
These Terms are governed by the laws of the State of Maryland, USA, without regard to conflict-of-laws rules. Any dispute not subject to arbitration will be heard only in the state or federal courts located in Maryland, and both parties consent to their jurisdiction. If you are a consumer in a country whose laws give you the right to bring claims in your local courts, this does not remove that right.
17. General
We may update these Terms. We will post the new version here, update the date above, and for material changes ask you to accept them again before your next interview; continuing to use the Service after that means you accept them. These Terms and the Privacy Policy are the entire agreement between us. If any part is unenforceable, the rest stays in effect. Not enforcing a term is not a waiver of it. You may not transfer these Terms; we may transfer them in connection with a reorganisation, merger or sale of the Service.
